Welcome to IGBot. By using our service, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using IGBot ("Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.

2. Description of Service

IGBot is an Instagram automation platform that allows users to:

  • Automatically send direct messages to users who comment on their Instagram posts with specific keywords
  • Auto-reply to comments on Instagram posts
  • Track and analyze message delivery and engagement

3. Account Requirements

3.1 Eligibility

You must be at least 18 years old to use this Service. By using IGBot, you represent and warrant that you meet this age requirement.

3.2 Instagram Account

To use IGBot, you must have a valid Instagram Business or Creator account. You are responsible for maintaining the security of your Instagram account and for all activities that occur under your account.

3.3 Account Security

You are responsible for safeguarding your IGBot account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. User Responsibilities

4.1 Compliance with Instagram Policies

You agree to use IGBot in compliance with Instagram's Terms of Use, Community Guidelines, and Platform Policy. We are not responsible for any actions Instagram may take against your account.

4.2 Prohibited Uses

You agree NOT to use IGBot to:

  • Send spam, unsolicited messages, or harass other users
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Distribute malware, viruses, or harmful content
  • Impersonate another person or entity
  • Engage in any activity that could damage, disable, or impair our Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service in a manner that, in our sole discretion, constitutes abuse, places excessive strain on our systems, or could jeopardize our standing with Meta/Instagram or our API access

4.3 Message Content

You are solely responsible for the content of messages sent through IGBot. You agree that all messages will be lawful, not harmful, and not violate any third-party rights.

5. Subscription and Payment

5.1 Free Trial

New users may be eligible for a 7-day free trial. At the end of the trial period, you must subscribe to continue using the Service.

5.2 Subscription Plans

The Service is offered on the following subscription basis:

  • Monthly: $9.90 per month, billed monthly
  • Yearly: $90 per year, billed annually (save 24%)

Subscriptions automatically renew unless canceled before the renewal date.

5.3 Payment

All payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access until the end of your current billing period.

5.5 Refunds

We do not offer refunds for partial subscription periods. If you cancel mid-cycle, you will have access until the end of that billing period.

6. Referral Program

6.1 Eligibility

The referral program is available to users with an active paid subscription or complimentary access. Users on a free trial are not eligible to participate until they subscribe.

6.2 How It Works

Eligible users receive a unique referral code that can be shared with others. When a new user signs up using your referral code and subsequently subscribes to a paid plan, you become eligible for commission payments.

6.3 Commission Structure

Commissions are calculated based on actual payments received. If a referred user cancels, commissions cease from that point. If a payment is refunded, the corresponding commission is voided.

6.4 Commission Payments

Commissions are processed manually on a monthly basis. There is no minimum payout threshold. Payment methods and timing are at our discretion.

6.5 Program Rules

The following activities are prohibited and may result in forfeiture of commissions and/or account termination:

  • Self-referral (referring yourself or accounts you control)
  • Creating fake or fraudulent accounts to generate referrals
  • Misrepresenting the Service or referral program
  • Using spam or unsolicited messaging to promote referral codes
  • Any form of referral fraud or abuse

6.6 Program Modifications

We reserve the right to modify, suspend, or terminate the referral program at any time, with or without notice. Changes to commission rates or terms will apply to future referrals only; existing referral relationships will honor the terms in effect at the time of signup.

6.7 Tax Responsibility

You are solely responsible for reporting and paying any taxes due on commission earnings. We may request tax information (such as a W-9 form for US participants) before processing payments.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by IGBot and are protected by international copyright, trademark, and other intellectual property laws.

8. Third-Party Services

IGBot integrates with Instagram's API. We are not affiliated with, endorsed by, or sponsored by Instagram or Meta. Any issues with Instagram's service are outside our control.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

  • The Service will be uninterrupted, secure, or error-free
  • Messages will be delivered successfully to all recipients
  • Your Instagram account will not face any restrictions from Instagram

10. Limitation of Liability

IN NO EVENT SHALL IGBOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Any actions taken by Instagram against your account
  • Failed message deliveries or automation errors
  • Referral commission disputes or payment delays

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless IGBot and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately. Pending referral commissions may be forfeited if termination is due to violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which IGBot operates, without regard to conflict of law provisions.
